Listing Agreement - Generous Media

In our efforts to maintain quality and usefulness to our users, as well as to the other professionals placing listings, we ask a few things.  First, please don't place listings in categories which you cannot provide the appropriate services.  Second, please don't advertise in states or cities where you cannot provide competent service or operate legally.

Prior to placing your listing, you must agree to this as well as the following:

You agree that all information provided in your listings will be truthful and accurate. You warrant that you and/or your company are properly licensed to perform the services you advertise in the jurisdictions which you market your services in our directories.   You agree to comply with all truth in advertising, truth in lending, fair trade practices and other applicable laws and industry guidelines with respect to the marketing of your products and services in our directories.  You represent and warrant that you have the rights and authority to place the listings in our directory.  You represent and warrant that your products and services do not violate any applicable law, regulation or ordinance or any third party right.  You acknowledge that we have no responsibility to review your materials and listings.  You also agree to the overall Terms of Use for PlumList.com published at http://plumlist.com/termsofuse.htm.

We shall not be subject to any liability for any failure to provide access to our servers or listings.  We do not guarantee availability of our website nor continuous or uninterrupted display of the directory.  We are under no obligation to continue publishing or marketing the directory on ours or others websites.  We will under no circumstances be liable to you for any special or consequential damages, and in no event shall our liability to you exceed the amount paid to us by you.  We reserve the right to reject or cancel any listing at any time for any reason, including, but not limited to, inappropriate content provided in your listing or inappropriate content found on your web site.

Failure to follow this Listing Agreement may result in your listing being removed.   We will not refund fees paid and are under no obligation to provide refunds.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", AND WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE AND ALL WARRANTIES RELATING TO THE RESULTS OF LISTING PURCHASED HEREUNDER.

This agreement shall be construed in accordance with the laws of the State of California and any disputes hereunder shall be adjudicated in the State of California, County of San Diego.

In this Agreement, We and Our refers to Generous Media, publisher of PlumList.com. You and Your refers to the Person, Company and/or Agent placing a Listing or other Advertisement in our directories or on our websites.
